Notes: "George White of Tetbury in the County of gloucester Mercer (Devisee of the last Will and Testament of John Weake late of Newnton in the County of Wilts Gentleman his Great Uncle deceased) and Mary his now Wife who was the only Child of Thomas Wayt late of Swindon in the said County of Wilts Gentleman also deceased of the first part"

From indenture between George White of the first part, John Harris and Joseph Butler of the second part, John White ("brother of the said George") and William Buy of the third part, dated 1757.

From the Swindon Parish records, it is known that there were multiple Thomas Wayts alive towards the start of the 17th century but only one has recorded children in the early 1720s. Thomas Wayt, married to Ann who had four children:- Thomas Kemble (1718-1718), Anne (1719-1719), Mary (1722- ), Sarah (1726-1730).

Ann's name is obtained from the burial record for his daughter Ann and Thomas's burial record. Given that three of Thomas's four childrens passed away as infants, it would seem to align with the statement in the indenture if Mary's father was the Thomas Wayt who married Ann.

The purpose of the indenture was the "Performance of certain articles of agreement made on the contract of marriage" betwen George White and Mary Wayt, agreed by Thomas Wayt. The articles of marriage are dated 19 May 1752 and Thomas was alive then. He was deceased when the indenture was written (1727). This therefore suggests Thomas's decease in between the two agreements.

The agreement also states that after the decease of the survivor of George and Mary, John White and William Buy would become executors and administrators of their remainder. William Buy was married to Anne Wayt daughter of Richard Wayt and Anne Vilett of Swindon.

Notes: Identifying Ann's identity with certainty is problematic. Even Ann's first name is obscure - she is named as a parent in the Wiltshire Memorials Index - yet no memorial has actually been found covering the individuals in the record.

The strongest evidence for her being a Kemble is the middle name of her oldest child, "Thomas Kemble Wayt". The Wayt's had a tradition of using middle names to signify maternal ancestors (e.g. the appearance of Villett, Wiltshire, White etc.) as middle names for Wayt family members.

All other evidence is circumstantial. For example we know that Mary Wayt, her sole surviving child, was leasing the parsonage of Stratton St Margaret. An assignment in 1747 also shows Thomas Wayt owned land in Stratton St Margaret. It seems likely that land was brought into the family through Ann's marriage settlement. The Kemble family were of Stratton St Margaret. We know Ann's first name from a burial for her daughter, Anne. There is an Anne born to a Henry Kemble, gent, in Stratton at approximately the right time. The evidence, however, is too weak to include here.

We know the Wayt and Kemble families were connected:-
John Wayt, butcher of Swindon (relative of Thomas), had William Kemble (baker) as his first named Executor in his will dated 1761.
William Kemble and Richard Wayt (brother of Thomas) were named as defendants in a 1734 chancery case against John Rose, gent of St Margaret Westminster, Middlesex and Rebecca Rose his wife (a younger child of Anthony Kemble, mercer, deceased late of Cirencester, Gloucestershire). This is not the same William as above - this William died in 1745.

John Rose's wife, Rebecca who was "the daughter and one of the younger children of Anthony Kemble, late of Cirencester, mercer, deceased"
"Rebecca's eldest brother William Kemble"
Land seems to have been surrendered by William Kemble to Richard Wayte, in trust, and for the benefit of William Kemble - which, per the will, should have been inherited by Rebecca
"Mary Kemble mother of the said William Kemble and the widow relict" (late - died some time between 1726 and 1734 it would seem)
Richard Wayte seems to have lent Mary £300 secured against the surrendered land
A William Barge seems to have had an interest through marriage from c1696 on Anthony Kemble's estate

There is no mention in the will of how the Kemble and Wayt families are connected if at all. It seems unlikely Ann is a daughter of Anthony on the basis of the "late sister" comment.

The only other possibly relevant evidence would be Mary Wayt holding copyhold land in her own right at Shrivenham Berkshire. Given the Wayt family did not seem to hold this land, it may have been obtained through an inheritance

If we do suppose Ann Kemble is the daughter of Henry Kemble and Mary Read, then that would mean Ann's step-father following Henry's death was Thomas Tuckey - who held extensive lands in areas eventually owned by members of the Wayt and White families.

Notes: Mary White's codicil to her will mentions that she was leasing the parsonage of Stratton St Margaret, Wiltshire, from Merton College, Oxford. Thomas Wayt her father also owned land in Stratton St Margaret per an assignment dated 3 April 1747.

Mary receives a bequest from Margaret Brind. In Margaret's will, Mary is described as daughter of Thomas, gentleman of Swindon.

Mary also would seem to have owned land in her own right - likely through inheritance - at Shrievenham, Berkshire. The write-up of the court case related to George White's heirs (see their profiles) states "The copyhold estate at Shrievenham (which the testator had bought of his wife) was not surrendered to the use of the will".
